Regional Council met at 9:34 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Fisch presiding.

It was moved by Mayor Emmerson, seconded by Regional Councillor Ferri that Council confirm the Minutes of the Council meeting held on March 25, 2010 in the form supplied to the Members.

PRESENTATION

 

Council then received the following presentation:

 

49        Human Services Planning Board

 

Regional Councillor Frustaglio introduced the proposed Members of the Human Services Planning Board (HSPB) of York Region. The HSPB will bring together a number of community leaders and community members from various sectors who will collaborate on strategies to improve human services within York Region and provide a strong and unified voice on the issue of human services. 

 

It was moved by Regional Councillor Frustaglio, seconded by Regional Councillor Hogg that:

 

1. Regional Council endorse an amendment to the Human Services Planning Board Terms of Reference to move some ex-officio members to a new membership category referred to as Government Advisor and Resource Member and that corresponding sections of the Terms of Reference be amended to reflect this change.

 

2. The following twenty-four individuals be appointed to the Human Services Planning Board of York Region for the inaugural term running from April 22, 2010 to November 30, 2014 in accordance with the Human Services Planning Board of York Region Terms of Reference:

50        National Access Awareness Week

 

Regional Councillor Vito Spatafora, Chair, York Region Accessibility Advisory Committee, March 30, 2010, requesting that Council recognize June 6 to June 12, 2010 as National Access Awareness Week. 

 

It was moved by Regional Councillor Spatafora, seconded by Regional Councillor Rosati that Council receive the communication and recognize the week of June 6 to June 12, 2010 as National Access Awareness Week.

51        National Organ and Tissue Donation Awareness Week

 

Frank Markel, President and Chief Executive Officer, Trillium Gift of Life Network, April 2010, requesting that Council recognize April 18 to 25, 2010 as National Organ and Tissue Donation Awareness Week.

 

It was moved by Mayor Emmerson, seconded by Mayor Young that Council receive the communication and recognize the week of April 18 to April 25, 2010 as National Organ and Tissue Donation Awareness Week.

53        National Hunger Awareness Day

 

Joan Stonehocker, Executive Director, York Region Food Network, April 21, 2010, requesting that Council recognize June 1, 2010 as National Hunger Awareness Day.

 

It was moved by Regional Councillor Hogg, seconded by Regional Councillor Frustaglio that Council receive the communication and recognize June 1, 2010 as National Hunger Awareness Day.

54        York Region Pride Week

 

Elisha Laker, Executive Director and Barbara Urman, Coordinator, York Region LGBT Community Project, April 15, 2010, requesting that Council recognize June 6 to June 13, 2010 as York Region Pride Week.

 

It was moved by Mayor Barrow, seconded by Regional Councillor Spatafora that Council receive the communication and recognize the week of June 6 to June 13, 2010 as York Region Pride Week.

It was moved by Regional Councillor Ferri, seconded by Mayor Emmerson that Council receive the communication and recognize the week of May 3 to May 7, 2010 as Girl's Rights Week.

56        COMMITTEE REPORTS

 

It was moved by Regional Councillor Frustaglio, seconded by Mayor Grossi that Council resolve itself into Committee of the Whole to consider the following reports:

Report No. 4 of the Finance and Administration Committee

Report No. 3 of the Planning and Economic Development Committee

Regional Chair Fisch chaired the Committee of the Whole.

 

The Committee of the Whole rose and recommended that Council adopt the recommendations in the following reports with amendments as noted:

 

Report No. 3 of the Community and Health Services Committee

 

Report No. 4 of the Environmental Services Committee

 

Clause No. 7, Progress Update for the Stage 3 Expansion Projects at the Duffin Creek Water Pollution Control Plant and Odour Management Plan Commitments, be adopted subject to Recommendation No. 3 being amended as follows:

 

3.  Regional Council:

 

(a) authorize the Commissioner of Environmental Services to negotiate and execute

agreements for reasons of compatibility under the sole source provisions of the Purchasing By-law with Team Duffin (CH2M Hill and AECOM) with Zorix as a sub-consultant to complete odour sampling, monitoring and reporting programs for an estimated assignment not to exceed $2,000,000; and

 

(b) waive the requirements of the Purchasing By-law and authorize the

Commissioner of Environmental Services to negotiate and execute agreements with Team Duffin (CH2M Hill and AECOM) to complete the conceptual design, design, tender documents, site supervision and construction administration of upgrades and refurbishment of the existing Stages 1 and 2, not to exceed $30,000,000.

 

Report No. 4 of the Finance and Administration Committee

 

Report No. 3 of the Planning and Economic Development Committee

 

Clause No. 1, Rouge Park Governance Review, be amended by amending Recommendation No. 3 and adding Recommendation No. 4 as follows:

 

3. Council strongly support the submission to the Government of Canada seeking Federal Park status subject to a commitment which protects Regional interests.

 

4. Council notify the Federal Government that the Regional interests in growth management, infrastructure and agriculture must be protected in any designation of Rouge Park as a Federal Park.

 

Clause No. 2, Richmond Hill Centre/ Langstaff Gateway Regional Centre, Process and Next Steps

 

In considering this clause, Council had before it a communication, April 16, 2010, from Peter Walker, Senior Principal and President, Walker, Nott, Dragicevic Associates Limited.

 

Report No. 4 of the Transportation Services Committee

 

Clause No. 1, Richmond Hill Centre/ Langstaff Gateway Regional Centre Transportation Study

 

In considering this clause, Council had before it a communication, April 16, 2010, from Peter Walker, Senior Principal and President, Walker, Nott, Dragicevic Associates Limited.

 

It was moved by Mayor Scarpitti, seconded by Mayor Emmerson that Council adopt the recommendations of the Committee of the Whole.

It was moved by Regional Councillor Heath, seconded by Mayor Jackson that Council introduce and approve certain Bills in the form as noted on the Revised Agenda and enact them as By-laws.

 

By-law No. 2010-27

A by-law to set and levy the rates of taxation for Regional general purposes for the year 2010

 

By-law No. 2010-28

A By-law for the provisions of municipal housing facilities.

 

By-law No. 2010-29

To acquire certain lands for or in connection with the widening and reconstruction of Bloomington Road (YR 40) Towns of Aurora and Richmond Hill

 

By-law No. 2010-30

A by-law to amend By-law No. 2009-23 being a by-law to designate lanes on regional roads for the exclusive use of certain classes of vehicles

It was moved by Regional Councillor Landon, seconded by Mayor Jackson that Council convene in Private Session for the purpose of considering the following:

 

1. Private Report of the Finance and Administration Committee - Settlement of Expropriation Claim - Town of Markham - Land Acquisition.

 

1. Private Report of the Transportation Services Committee - York Region Transit - Transit-Secure Final Report - Security of Municipal Property.

 

3. Private Report of the Community and Health Services Committee - Appointment of Associate Medical Officer of Health - Personal Matter about an Identifiable Individual.

59        Settlement of Expropriation Claim - Town of Markham

 

It was moved by Regional Councillor Jones, seconded by Mayor Jackson that Council authorize the settlement of the expropriation claim and that the report remain confidential under the provisions of the Municipal Act.

60        York Region Transit - Transit-Secure Final Report

 

It was moved by Mayor Grossi, seconded by Regional Councillor Wheeler that Council receive the private report and that the report remain confidential under the provisions of the Municipal Act.

61        Appointment of Associate Medical Officer of Health

 

It was moved by Regional Councillor Heath, seconded by Mayor Barrow that Council adopt the recommendations contained in the private report and that the report remain confidential under the provisions of the Municipal Act.

62        North Leslie OMB Decision for the Review Lands - March 16, 2010 - Town of Richmond Hill

 

It was moved by Regional Councillor Taylor, seconded by Regional Councillor Virgilio that Council adopt the recommendations in the confidential memorandum, as amended, as follows:

 

1. That Regional Staff be authorized to take all actions necessary to request a review of the OMB decision on the North Leslie re-hearing issued March 16, 2010 pursuant to Section 43 of the OMB Act and in support of a similar request by the Town.

 

2. That Regional Staff be authorized to take all actions necessary to defend against any request by any one or all of the landowners to review the OMB decision on the North Leslie re-hearing issued March 16, 2010 pursuant to Section 43 of the OMB Act.

 

3. That the Commissioner of Planning and Development Services be authorized to take all steps necessary to request the Assistant Deputy Minister responsible to:

 

a. Formalize the Province's methodology for the calculation of employment land;

b. Ensure the long-term protection of strategic employment lands;

c. Develop clarity in the PPS for communities regarding the 10-year residential supply; and,

d. Establish a Provincial policy that declares a Provincial Interest in strategic employment lands in the GTA.

 

4. That Council ratify the actions of staff that have been taken to date.

 

5. The balance of the memorandum to remain confidential under the provisions of the Municipal Act.

It was moved by Regional Councillor Landon, seconded by Mayor Morris that Council enact the following by-law to confirm the proceedings of this meeting of Council.
