Regional Council met at 9:35 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Fisch presiding.

Mayor Black disclosed an interest in Clause 11 of Transportation and Works Committee Report No. 6 as it relates to the YDSS Interceptor Trunk Sewer as her spouse works for a company that is a sub-contractor on this project. Mayor Black did not take part in the consideration or discussion of or vote on this item.

It was moved by Regional Councillor Jones, seconded by Regional Councillor Barrow, that the Minutes of the Council meeting held on the 27th of April, 2006, be confirmed in the form supplied to the Members.

Claudie Graner, Co-President TESL North York/York Region and Susan Richarz, Co-President, TESL North York/York Region, April 10, 2006, regarding "English as a Second Language Week" � November 12 � 18, 2006.
It was moved by Mayor Young, seconded by Regional Councillor Ferri, that Council recognize November 12 � 18, 2006 as "English as a Second Language Week."

74 Pride Week, 2006
Marilyn Byers, President, PFLAG Canada � York Region, Director, PFLAG Canada, April 20, 2006, requesting that the Region recognize June 12 through June 18, 2006 as "Pride Week, 2006."
It was moved by Mayor Taylor, seconded by Regional Councillor Frustaglio, that the communication dated April 20, 2006 be received and Council recognize June 12 through 18, 2006 as "Pride Week, 2006."

Mayor Taylor presented the following reports for the consideration of Council:

It was moved by Mayor Taylor, seconded by Mayor Young, that the reports be received and that Council resolve itself into Committee of the Whole to consider them.
Carried
Regional Chair Fisch chaired the Committee of the Whole.
The Committee of the Whole rose after making the following recommendations:
Report No. 4 of the Community Services and Housing Committee be adopted, without amendment;
Report No. 5 of the Finance and Administration Committee be adopted with the following amendments:
The staff recommendations contained in Clauses 1 through 5 of the Report be adopted;
and
Clause 6, Update � Committee Proceedings, be received.
Report No. 4 of the Health and Emergency Medical Services Committee be adopted, without amendment;
Report No. 5 of the Planning and Economic Development Committee be adopted without amendment;
(Prior to adopting Clause 1, relating to Transportation Improvements, Markham Bypass to Morningside Avenue Link, Environmental Assessment, the Clause was referred to Private Session for discussion of legal issues pertaining to the project. The Clause was subsequently adopted, without amendment. )

Report No. 6 of the Transportation and Works Committee be adopted, with the following amendments:

77 2006 American Public Transit Association Innovation Award
Regional Chair Fisch announced that York Region will be awarded the prestigious American Public Transit Association (APTA) 2006 Innovation Award for its transit system at the Association's annual conference in

Regional Chair Fisch noted that the annual challenge issued by the Mayor of Richmond Hill was held on May 24th in which the members representing the ten councils in York Region competed in events such as sidewalk snowplow racing. Mayor Young, Mayor Grossi and Regional Councillor Jones were to be congratulated for their successes, with special note to be made of Mayor Sherban and the team from Whitchurch-Stouffville in winning the overall prize. Mayor Bell joined in congratulating all who participated.
79 Joe Dales
Regional Chair Fisch acknowledged with sadness the passing of Joe Dales on May 16, 2006.
Joe Dales will be remembered for his political activities from the 1950's through 1980's in
Regional Council observed a moment of silence in memory of the late Joe Dales.
PRIVATE SESSION
80 It was moved by Regional Councillor Jones, seconded by Regional Councillor Wheeler, that
Council convene in Private Session for the purpose of considering a legal matter and matters relating to land acquisition and the security of municipal property.

Council met in Private Session at 10:10 a.m. and reconvened in Council at 11:25 a.m.

Revised Financial Terms For Miller Transit Ltd.
Conventional Service Contract Extension
It was moved by Regional Councillor Jones, seconded by Mayor Sherban, that Council adopt the recommendations contained in the confidential report of the Commissioner of Transportation and Works as follows:
1. The York Region Transit Division 1 (Markham/Whitchurch-Stouffville) contract with Miller Transit Ltd. be extended for a period of five years, to April 2, 2011, on the terms and conditions outlined in this report, including a year one hourly rate of $68.08 for the January to May, 2006 period, and $63.57 for the June to December, 2006 period, the latter to be adjusted in future years based on the Consumer Price Index (Toronto-All Items), with a minimum annual increase of 2.5%, and that the contract be converted to a performance-based contract.
2. The York Region Transit Division 3 (
3. The consolidated contract include a provision for cost adjustments relating to vehicle blocking efficiencies identified by the Region and the resulting impact on driver change-offs to the contractor.
4. The Region enter into a ten year lease agreement with Miller Transit Ltd., commencing June 1, 2006, for the transit operations and maintenance facility located at 8050 Woodbine Avenue,
5. The foregoing recommendations supersede recommendations 1 and 2 embodied in Minute No. 176 of the Regional Council meeting held on October 27, 2005.
6. The Regional Chair and Regional Clerk be authorized to sign the necessary contracts subject to review by Legal Services.

The balance of the report to remain confidential under the provisions of the Municipal Act as it contains information relating to the security of municipal property.

It was moved by Mayor Sherban, seconded by Regional Councillor Wheeler, that Council adopt the recommendations contained Clause 1 of Planning and Economic Development Committee Report No. 5.

83 CONFIRMATORY BY-LAW
It was moved by Regional Councillor Frustaglio, seconded by Mayor Cousens, that the following by-law be enacted to confirm the proceedings of this meeting of Council.
