Regional Council met at 9:31 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Fisch presiding.

 

The following were present at this Meeting:

135      Tender Awards Report April 1, 2011 to June 30, 2011

(Clause 3 of Finance and Administration Committee Report No. 7)

 

Mayor Emmerson declared an interest in Clause 3 of Finance and Administration Report No. 7, as it relates to Contract T-11-26, as his brother is the owner of Gradall Services referred to in the contract.  Mayor Emmerson did not take part in the consideration, discussion or vote on this clause.

 

Mayor Scarpitti declared an interest in Clause 3 of Finance and Administration Report No. 7, as it relates to Contract A017273, as his brother works for Compugen Inc.  Mayor Scarpitti did not take part in the consideration, discussion or vote on this clause.

136      Status Update Report No. 2 on Regional Official Plan Appeals, ROPA 2, City of Vaughan

(Clause 8 of Planning and Economic Development Committee Report No. 7)

 

Regional Councillor Di Biase declared an interest in Item 11 of Clause 8 of Planning and Economic Development Report No. 7, as his children have a part interest in a parcel of land which was purchased by his maternal grandfather.  Regional Councillor Di Biase did not take part in the consideration, discussion or vote on this clause.

It was moved by Regional Councillor Jones, seconded by Regional Councillor Schulte that Council confirm the Minutes of the Council meeting held on June 23, 2011 in the form supplied to the Members.

Council considered the following communications:

 

138      Lupus Awareness Month

 

Kathy Crowhurst, Lupus Foundation of Ontario, June 22, 2011, requesting that Council recognize October as Lupus Awareness Month.

 

It was moved by Mayor Emmerson, seconded by Regional Council Spatafora that Council receive the communication and recognize October as Lupus Awareness Month.

139      Character Community Week

 

Karen Addison, Executive Director, Character Community Foundation of York Region, July 19, 2011, requesting that Council recognize October 24 - 29, 2011 as Character Community Week, and requesting deputant status.

 

It was moved by Mayor Barrow, seconded by Regional Council Di Biase that Council receive the communication, recognize October 24 - 29, 2011 as Character Community Week and grant deputant status.

140      Franco-Ontarian Day

 

Alain Beaudoin, President, L'Association des francophones de la region de York Inc., July 28, 2011, requesting that Council recognize September 25, 2011 as Franco-Ontarian Day.

 

It was moved by Mayor Grossi, seconded by Regional Councillor Schulte that Council receive the communication and recognize September 25, 2011 as Franco-Ontarian Day.

141      Child Care Workers

 

Fred Hahn, President, CUPE Ontario and Tracy Saarikoski, President, OCBCC, CUPE SCFP Ontario, August 23, 2011, requesting that Council recognize Child Care Worker and Early Childhood Educator Appreciation Day on October 26, 2011.

 

It was moved by Mayor Hackson, seconded by Regional Councillor Wheeler that Council receive the communication and recognize Child Care Worker and Early Childhood Educator Appreciation Day on October 26, 2011.

DEPUTATIONS

 

Council then heard the following deputations:

 

142      Lake Simcoe Conservation Authority

 

It was moved by Mayor Hackson, seconded by Mayor Van Bynen that Council permit Gayle Wood, Chief Administrative Officer, Lake Simcoe Region Conservation Authority, to address Council.

Carried

 

Gayle Wood, Chief Administrative Officer, Lake Simcoe Region Conservation Authority, addressed Council regarding the Authority's 60th Anniversary of providing leadership in the protection and restoration of Lake Simcoe and surrounding watersheds. She also presented Council with a limited edition signed print in appreciation of the ongoing partnership between the Conservation Authority and Regional Council.

 

It was moved by Mayor Hackson, seconded by Regional Councillor Taylor that Council receive the deputation.

143      United Way 2011 Campaign

 

It was moved by Mayor Scarpitti, seconded by Regional Councillor Jones that Council permit Danielle Zanotti, Chief Executive Officer of the United Way of York Region to address Council.

Carried

 

Daniele Zanotti, Chief Executive Officer, United Way of York Region addressed Council regarding the 2011 United Way campaign.  He thanked the Region and the nine local municipalities for combining to donate over $800,000 to the United Way of York Region campaign in 2010. This was over 10% of the total donations to the campaign.

 

Regional Chair Fisch indicated that the Region's campaign kicked-off last week with a target of $380,000 for 2011.

 

It was moved by Mayor Scarpitti, seconded by Mayor Dawe that Council receive the deputation.

144      Character Community Foundation of York Region

 

Karen Addison, Character Community Foundation of York Region addressed Council regarding the 10th Anniversary of the Character Community Foundation of York Region. The attribute for October is "inclusiveness" and the "Show us your Character Challenge" event will take place during Character Community Week, to be held October 24 - 29, 2011.

 

It was moved by Mayor Barrow, seconded by Regional Councillor Heath that Council receive the deputation.

145      July 11, 2011 Dalton Road Fire, Town of Georgina

 

Regional Chair Fisch and Mayor Grossi offered their thanks to Regional staff, who went to great lengths in collaboration with our community partners, the Red Cross and the Salvation Army, to provide assistance, housing, food, healthcare and counseling  to the approximately 100 victims of the devastating fire that occurred on Dalton Road in July 2011.

 

 

146      COMMITTEE REPORTS

 

It was moved by Mayor Dawe, seconded by Mayor Hackson that Council resolve itself into Committee of the Whole to consider the following reports:

It was moved by Mayor Scarpitti, seconded by Regional Councillor Wheeler that Council adopt the recommendations of the Committee of the Whole.

It was then moved by Regional Councillor Heath, seconded by Regional Councillor Rosati that Council reconsider its adoption of the Committee of the Whole recommendations to permit a recorded vote on Clause 1 of Transportation Services Committee Report No. 7 pertaining to 2012 transit fares. The motion did not obtain the required vote of 2/3 of the Members present.

It was moved by Regional Councillor Di Biase, seconded by Regional Councillor Landon that Council introduce and approve certain Bills in the form as noted on the Revised Agenda and enact them as Bylaws.

A Bylaw to amend Bylaw No. R-1311-2002-113 being a bylaw to prescribe maximum rates of speed on Yonge Street/Bradford Street/Mount Albert Sideroad (Y.R. 13)

A Bylaw to amend Bylaw No. R-1307-2002-109 being a bylaw to prescribe maximum rates of speed on Baseline Road (Y.R. 8A)

148      2012 Calendar of Council and Committee Meetings

 

It was moved by Regional Councillor Wheeler, seconded by Mayor Scarpitti that Council adopt the 2012 Calendar of Council and Committee meetings as amended to provide that all meetings for the December 2012 cycle be moved forward by one week.

149      Official Opening - Town of Whitchurch-Stouffville Town Hall

 

The official opening of the new Municipal Offices for the Town of Whitchurch-Stouffville will be held on Saturday, September 24, 2011 and Mayor Emmerson extended an invitation to all Regional Council members to attend.  Mayor Emmerson also noted that their annual food drive will kick off next week and will also include a coat drive this year.

 

 

150      Official Opening - City of Vaughan City Hall

 

The official opening of the new Vaughan City Hall will be held on Sunday, September 25, 2011 and Mayor Bevilacqua extended an invitation to all Regional Council members to attend.

 

151      Tastes of the Hill

 

Regional Councillor Spatafora invited all members of Regional Council and staff to attend the fifth annual "Tastes of the Hill" multicultural food festival in Richmond Hill on October 2, 2011.

 

 

152      PRIVATE SESSION

 

It was moved by Mayor Grossi, seconded by Regional Councillor Spatafora that Council convene in Private Session for the purpose of considering the following:

 

1. Private Report of the Finance and Administration Committee and Private Memorandum - Appeal, York Region Official Plan - 2010, Ninth Line, Markham - Litigation and Land Acquisition and Disposition.

 

2. Private Briefing by the Commissioner of Transportation Services - Transit - Labour Relations.

Council met in Private Session at 11:40 a.m. and reconvened in Council at 11:55 a.m.

 

It was moved by Mayor Grossi, seconded by Regional Councillor Landon that Council rise and report from Private Session.

153      Appeal, York Region Official Plan - 2010, Ninth Line, Markham

 

It was moved by Regional Councillor Heath, seconded by Regional Councillor Jones that Council adopt the recommendations contained in the private report of the Finance and Administration Committee, as amended to read as follows:

 

1. Council authorize the stopping up and closing of part of the former Ninth Line right of way north of Donald Cousens Parkway, being Parts 6 through 13 inclusive on Plan 65R-33161.

 

2. The Commissioner of Corporate Services be authorized to complete the following transactions between Cornerstone Community Church and the Region:

 

i) Conveyance of Parts 6, 7, 10 and 11 on Reference Plan 65R-33161 from the Region to Cornerstone Community Church at no cost, and

 

ii) Conveyance of Parts 1, 2 and 3 on Reference Plan 65R-33161 from Cornerstone Community Church to the Region at no cost for future street widenings and reserves associated with Donald Cousens Parkway and Parts 4 and 5 on Reference Plan 65R-33161 to the Region at no cost for future reserves associated with Ninth Line.

Bylaw No. 2011-52

To stop up and close a portion of Ninth Line (Y.R. 69) in the Town of Markham

 

It was moved by Mayor Scarpitti, seconded by Mayor Dawe that Council approve Bill 2011-52  and enact it as a Bylaw.

155      Update - Commissioner of Transportation Services regarding Transit Service

 

It was moved by Regional Councillor Hogg, seconded by Regional Councillor Rosati that Council receive the confidential update from the Commissioner of Transportation Services.

It was moved by Mayor Bevilacqua, seconded by Mayor Grossi that Council enact the following bylaw to confirm the proceedings of this meeting of Council.
