Regional Council met at 9:30 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Fisch presiding.

It was moved by Mayor Young, seconded by Mayor Morris that Council confirm the Minutes of the Council meeting held on January 22, 2009 in the form supplied to the Members.

Council considered the following communications:

 

13        March 2009 � Red Cross Month

 

Jerry Chwang, Branch President, Canadian Red Cross, February 9, 2009, requesting recognition of March 2009 as Red Cross Month.

 

It was moved by Regional Councillor Hogg, seconded by Regional Councillor Jones that the communication be received and that Regional Council recognize March 2009 as 'Red Cross Month'.

14        Hospital Capital Funding

            (Clause 2 of Finance and Administration Committee Report No. 2)

It was moved by Regional Councillor Landon, seconded by Regional Councillor Spatafora that the communication be received and referred to consideration of Clause 2 of Finance and Administration Committee Report No. 2.

15        COMMITTEE REPORTS

 

It was moved by Regional Councillor Spatafora, seconded by Regional Councillor Rosati that Council resolve itself into Committee of the Whole to consider the following reports:

 

Report No. 2 of the Finance and Administration Committee

Report No. 2 of the Health and Emergency Medical Services Committee

Report No. 2 of the Planning and Economic Development Committee

Report No. 2 of the Transit Committee

Report No. 2 of the Transportation and Works Committee

Carried

 

Regional Chair Fisch chaired the Committee of the Whole.

 

The Committee of the Whole rose and recommended that Council adopt the recommendations in the following reports with amendments as noted:

 

Report No. 2 of the Finance and Administration Committee, with the following amendment:

 

Clause 1, relating to the 2009 Operating Budget, and Clause 2 relating to the Hospital Capital Funding in the 2009 Operating Budget, were referred to Council for discussion.

Report No. 2 of the Health and Emergency Medical Services Committee, with the following amendment;

 

Clause 1, Optimizing Services Delivery � 2009 Paramedic Growth Request, was referred to Council for discussion with the 2009 Operating Budget.

It was moved by Regional Councillor Hogg, seconded by Mayor Grossi that Council introduce and approve certain Bills in the form as noted on the Revised Agenda and enact them as By-laws.

To establish charges for the uniform wastewater service rate

17        MOTION

 

Greater Toronto Transportation Authority (GTTA)

 

It was moved by Mayor Barrow, seconded by Mayor Emmerson that the Council of the Regional Municipality of York recommends that Regional Chair Bill Fisch be nominated as its representative on the Board of Directors of the Greater Toronto Transportation Authority (GTTA).

Council then received the following presentation:

 

18        2009 Operating Business Plan and Budget

(Clauses 1 and 2 of Finance and Administration Committee Report No. 2 and Clause 1 of Health and Emergency Medical Services Committee Report No. 2)

 

Bruce Macgregor, Chief Administrative Officer and Lloyd Russell, Commissioner of Finance provided Council with an overview and highlights of the proposed 2009 Operating Business Plan and Budget, including the budget process, results of the Committee reviews, additional initiatives and operating budget highlights.

 

The proposed 2009 Operating Business Plan and Budget contains a gross operating budget of $1,348.4 million, with net operating expenditures of $738.6 million. It also includes a proposed 0.2% reserve for social services and social housing programs. This results in a recommended Regional tax levy increase of 2.5% with an impact of $49 on an average residential property assessed at $400,000.

 

It was moved by Mayor Van Bynen, seconded by Mayor Barrow that the presentation be received and that Clauses 1 and 2 of the Finance and Administration Committee Report No. 2 and Clause 1 of Health and Emergency Medical Services Committee Report No. 2 be considered at this time.

19        Optimizing Services Delivery � 2009 Paramedic Growth Request

(Clause 1 of Report No. 2 of the Health and Emergency Medical Services Committee)

 

It was moved by Regional Councillor Heath, seconded by Regional Councillor Hogg that Council adopt the recommendation contained in Clause 1 of Health and Emergency Medical Services Committee Report No. 2.

It was then moved by Mayor Grossi, seconded by Regional Councillor Spatafora that Council adopt recommendation 1 contained in the report of the Commissioner of Community and Health Services, February 3, 2009 as follows:

 

1. Regional Council approve an additional six full-time Paramedic positions to increase service hours at the Pefferlaw Paramedic Response Station, in the Town of Georgina, from 12 hours per day to 24 hours per day at an additional cost of $658,000 to be fully offset by additional provincial funding.

20        Hospital Capital Funding in the 2009 Operating Budget

(Clause 2 of Finance and Administration Committee Report No. 2)

 

It was moved by Mayor Van Bynen, seconded by Regional Councillor Frustaglio that Council approve Part 1 of the Motion contained in Clause 2 of Finance and Administration Committee Report No. 2, regarding increasing the existing budgeted contribution to hospital financing from $7.3 million to $12 million, as amended to add the following:

 

"and that the balance of required funding be re-allocated from within the overall non-program budgets to stay within the 2.5% overall increase."

It was moved by Mayor Van Bynen, seconded by Regional Councillor Frustaglio that Council approve Part 2 of the Motion contained in Clause 2 of Finance and Administration Committee Report No. 2, regarding staff reporting to Council in June 2009 with further details of funding and an MOU with the three hospitals and Vaughan Health Campus of Care, including a number of listed elements.

21        2009 Operating Budget

(Clause 1 of Finance and Administration Committee Report No. 2)

 

It was moved by Mayor Van Bynen, seconded by Mayor Barrow that Council adopt the recommendations in Clause 1 of Finance and Administration Committee Report No 2 regarding approval of the 2009 Operating Budget.

 

It was moved in amendment by Regional Councillor Spatafora, seconded by Regional Councillor Rosati that the Region's staff complement be reduced by 30 FTE's from current vacancies or proposed new positions that are tax-rate supported and do not affect public safety, and that the savings be applied to reducing the 2009 tax levy.

 

A recorded vote on the amendment moved by Regional Councillor Spatafora, seconded by Regional Councillor Rosati was as follows:

 

For:                  Emmerson, Frustaglio, Grossi, Heath, Jones, Morris, Rosati, Scarpitti,

                        Spatafora, Taylor and Young (11)

It was moved in amendment by Mayor Scarpitti, seconded by Regional Councillor Rosati that the 2009 Operating Budget be approved as presented with a 0% tax levy increase, by using the 2008 surplus to offset any increases in expenditures.

22        PRIVATE SESSION

 

It was moved by Regional Councillor Landon, seconded by Regional Councillor Jones that Council convene in Private Session for the purpose of considering the following:

 

1. Private Report of the Finance and Administration Committee re: Disposition of Matters under the Amended Purchasing By-law, 2008 � Litigation.

 

2. Private Attachment to Clause 4 Report 2 of the Transit Committee - York Region Transit Mobility Plus Appointments to Eligibility Appeal Panel � Personal Matters About Identifiable Individuals.

 

3. Private Report of the Commissioner of Planning and Development Services and the Regional Solicitor � Settlement of Appeal of Town of Richmond Hill Official Plan Amendment 246 � Litigation or potential litigation including matters before administrative tribunals

 

4. Private Verbal Briefing from the Commissioner of Transportation Services � York Region Transit Revenue-Related Issues � Security of Municipal Property.

Council met in Private Session at 1:05 p.m. and reconvened in Council at 1:43 p.m.

 

It was moved by Regional Councillor Heath, seconded by Mayor Emmerson that Council rise and report from Private Session.

23        York Region Transit Mobility Plus � Appointments to Eligibility Appeal Panel

(Clause 4 of Transit Committee Report No. 2)

 

It was moved by Regional Councillor Jones, seconded by Mayor Young that Council receive and make public the private attachment to Clause 4 of Transit Committee Report No. 2, and that:

 

1. Albert Ganesh be appointed to the York Region Transit Mobility Plus Eligibility Appeal Panel as a disabled community representative;

2. Keith Tse be appointed as the medical health practitioner representative on the Panel; and

3. Lana Ricci be appointed to the York Region Transit Mobility Plus Eligibility Appeal Panel as a disabled community representative replacing the Manager, Mobility Plus.

24        Settlement of Appeal of Town of Richmond Hill Official Plan Amendment 246

 

It was moved by Mayor Barrow, seconded by Regional Councillor Spatafora that Council adopt the recommendations contained in the private report of the Commissioner of Planning and Development Services and the Regional Solicitor, dated February 11, 2009 as follows:

 

1. Regional Council authorize the settlement of the appeal in this matter on the terms set out in this report; and

 

2. Regional Council authorize the Regional Solicitor to execute Minutes of Settlement

substantially in the form attached to the report as Private Attachment 1.

The balance of the report to remain private under the provisions of the Municipal Act as it pertains to litigation or potential litigation including matters before administrative tribunals, affecting the Region.

25        CONFIRMATORY BY-LAW

 

It was moved by Mayor Black, seconded by Mayor Scarpitti that Council enact the following by-law to confirm the proceedings of this meeting of Council.
