NEWMARKET - In a decision at the Ontario Superior Court of Justice on Friday, Madame Justice Alexandra Hoy dismissed an application by King Township to quash a By-law giving the Regional Municipality of York control of the King City Sewer system.
The decision helps pave the way to link King City to the York Durham Sewer System (YDSS).
"Obviously we are pleased with Justice Hoy's decision, " said Regional Chair and CEO Bill Fisch. "Throughout this process, we have always maintained that the YDSS is the preferred servicing solution for the residents and business of King City. We continue to look forward to working with King Township to ensure the long-term health of its residents through access to proper sewer services."
The ruling follows a number of overturned legal challenges brought forth by King Township on the proposed YDSS link. The Region assumed control of the King City sewer system in 2001, when King Township declined to accept the recommendation of the YDSS's conventional gravity collection system as the preferred solution to its failing septic systems.
King Township has the option to appeal the ruling.
