Additional member of Regional Council to take office following November 2003 Municipal Election

 
NEWMARKET An article in today's edition of the Toronto Star entitled "Vaughan to add a councillor, gain clout at York Region" contains erroneous information regarding a by-law approved yesterday by York Regional Council.

The by-law allows the Regional Municipality of York to change the composition and size of Regional Council to allow for an additional member from the City of Vaughan who has been elected as a member of York Regional Council and of the Council of the City of Vaughan.

In addition, the new member from the City of Vaughan will be elected in the November 10, 2003 Municipal Election, and will take office on December 1, 2003. The by-law had to be enacted by December 31, 2002 in order to be in effect for the November 2003 election.

Unfortunately, the Toronto Star article indicates the new member of Regional Council will take office in January 2003, but that is incorrect.

Below  for your information is BY-LAW NO. A-0318-2002-160 that York Regional Council approved yesterday.

THE REGIONAL MUNICIPALITY OF YORK

BY-LAW NO. A-0318-2002-160

A By-law to Change the Composition and Size of Regional Council.

 

WHEREAS Section 27 of the Municipal Act, R.S.O. 1990, c.M.45, as amended, provides that the council of an upper-tier municipality may, by by-law, change the composition and size of the council;

AND WHEREAS Section 27(9) of the Municipal Act further provides that this section does not apply to an upper-tier municipality until the Minister makes a regulation declaring that the section applies to the upper-tier municipality;

AND WHEREAS the Minister has filed Regulation No. 319/02 on November 25, 2002 declaring that Section 27 applies to The Regional Municipality of York;

AND WHEREAS Section 6(1) of the Municipal Elections Act, 1996, S.O. 1996, c.32, as amended, provides that the term of all offices to which that Act applies is three years, beginning on December 1 in the year of a regular election.

The Council of The Regional Municipality of York hereby enacts as follows:

  1. The composition and size of Regional Council is changed to consist of twenty-one members, being the existing twenty members plus an additional member from the City of Vaughan who has been elected as a member of the Regional Council and of the Council of the City of Vaughan.
     
  2. The additional member from the City of Vaughan shall first be elected in the 2003 regular municipal election and shall take office on December 1, 2003.
